Law Enforcement Guidelines

Introduction

These operational guidelines are provided for law enforcement officials seeking information from Joyo Technology Pte. Ltd and its affiliates. SnackVideo is owned and operated by Joyo Technology Pte. Ltd.

We are committed to cooperating with Law Enforcement agencies while respecting users' privacy, therefore we have established transparent and standard procedures to handle the validated requests.

We disclose user information in accordance with our Terms of Service , Privacy Policy and applicable law. If you are an authorized law enforcement agent or government employee gathering evidence and investigating in official capacity or in the case of an emergency involving imminent harm, or risk of death or serious physical injury to any person, you may request through the procedures below. Emergency requests will be reviewed on a case-by-case basis in accordance to the law.

Please note : Every request we receive is carefully reviewed for legal sufficiency and we may reject or require greater specificity for requests that appear overly lioad or vague. Joyo Technology Pte. Ltd will not respond to requests for user data sent by non-law enforcement officials or when they are sent through informal channels.

Outreach Guidelines

To facilitate the request, law enforcement must take into account applicable privacy and data protection requirements, and at minimum provide the necessary information in their request, including but not limited to:

1. Copy of FIR and/or formal approved copy of inqury along with copy of complaint.

2. Clear grounds for the legal basis for the request, which may include citing the relevant article of and Act/Statute/Code, the type of offence(s) under investigation and the connection to the Kwai/SnackVideo platform.

3. Specific data categories and date limitations. For types of data we may collect, please refer to our Privacy Policy..

4. The name of the issuing authority and agent, email address from a law-enforcement domain, and direct contact phone number.

5. The email address, phone number, user ID number or username of the Kwai/SnackVideo profile(account URL), Video ID (video URL)

6. Data requested should clearly specify the scope of the data requested. Overly lioad requests will be refused.

7. Date range- The request must specify a date (and, if possible, a time), or a date range as relevant to the request (for historic data only).

Submission of Requests

If you are a law enforcement agent, government official, or other third-party intending to submit a valid legal request, please visit our online Law Enforcement Online Request System. This is the most efficient method to reach out to us.

Types of information that may be available

Joyo Technology Pte. Ltd may hold the following user data which can be the subject of a valid law enforcement request:

Each request must clearly specify the type of data requested and the legal basis for requesting it. If the request does not meet the applicable legal requirements for the requested data, the data will not be disclosed. This is in particular the case for requests relating to content data (which generally require a domestic court / judicial order, warrant or equivalent).

Notification

We follow our policy to notify users of requests for their information before disclosing their data to law enforcement, unless providing such notice: (a) is prohibited under applicable law; (b) would jeopardize an investigation; and/or (c) would put individuals at risk of harm. Law enforcement officials should obtain an appropriate court order or other appropriate process establishing that notice is prohibited.

Emergency requests

In responding to an emergency involving imminent harm, or risk of death or serious physical injury to any person, we will evaluate on a case-by-case basis. After validating the urgency or exigency following our standard procedures, we shall initiate a timely response without delay and provide the necessary data in accordance with the applicable law.

Please Note: We will not review or respond to requests submitted by non-law enforcement officials. Users aware of an emergency situation should immediately and directly contact local law enforcement officials.

Preservation of data

We store and maintain information as described in our Privacy Policy and Terms of Service. Upon receipt of a formal written request by email to ts-lert@snackvideo.com, we will work to preserve records in connection with official criminal investigations for 90 days. We may honour Law enforcement extention of preservation request, for an additional 90 days but encourage law enforcement agencies to seek records through the appropriate channels in a timely manner, as we cannot guarantee that requested information will be available. We do not maintain preserved materials unless we receive an extension request or legal process.

If you will be submitting a preservation extension request, we recommend that you submit it at least a week (7 days) prior to the end of the preservation period, to allow for sufficient processing time.

Mutual Legal Assistance Treaties

Our policy is to prompty respond to requests that are in accordance with our terms of service and are properly issued via Mutual legal assistance treaties ("MLATS") or letters rogatory, upon proper service of process. When submitting requests through an MLAT procedure, please make clear that the request is coming by way of MLAT and include the name of the originating country.

In submitting a request, law enforcement officials are required to ensure that any information provided is complete and accurate to the best of their knowledge and good faith belief, and that the disclosure (or other action) requested is necessary and proportionate for the purposes of the prevention, detection or investigation of offences, or to prevent an emergency. Once received by law enforcement, the law enforcement authority is required to handle such data in accordance with applicable laws, including relevant data protection laws.

Cost Reimbursment

We may seek reimbursement for costs in responding to requests for information as provided by law. These fees apply on a per-account basis. We may also charge additional fees for costs incurred in responding to unusual or burdensome requests. We may waive these fees in matters investigating potential harm to children emergency requests.

FAQ

How can you access the private information of a user?

Access to private/ Non-public information of users requires subpoena or court order. Non-public information will not be released to law enforcement except in response to appropriate legal process such as a subpoena, court order, other valid legal process, or in response to a valid emergency request.

How can you access the contents of communication (videos, direct message etc.)

Requests for the contents of communications require a valid search warrant or equivalent from an agency with proper jurisdiction over Joyo Technology Pte. Ltd.

Production of records

Unless otherwise agreed upon, we provide responsive records in electronic format (i.e., text files that can be opened with any word processing software such as Word or TextEdit).

Records authentication

The records that we produce are electronically signed to ensure their integrity at the time of production. If you require a declaration, please indicate it in your submission.
